Sing the Anthem of the Philippines

The National anthem of the Philippines is played in most public places once a week and people stand still or sing along. I use to do the same, but in the west we seem to have lost our national pride where the Pinoys have not. The anthem has the following English translation

Land of the morning
Child of the sun returning
With fervor burning
Thee do our souls adore.

Land dear and holy,
Cradle of noble heroes,
Ne’er shall invaders
Trample thy sacred shores.

Ever within thy skies and through thy clouds
And o’er thy hills and seas;
Do we behold thy radiance, feel the throb
Of glorious liberty.

Thy banner dear to all hearts
Its sun and stars alright,
Oh, never shall its shining fields
Be dimmed by tyrants might.

Julian Felipe

The national anthem, “Lupang Hinirang” was composed by Julian Felipe on June 12, 1898 for the Independence from the Spanish, after the Spanish had lost the war to the Americans. After 327 years under Spanish rule, the Spanish-American War ended the Spanish colonial period. The Filipinos thought that they won independence in 1898.  But that was a wishful thinking! The Philippines was controlled by the Americans from 1900-1942. Then a short Japanese occupation period 1942-1945 followed, before  the Americans defeated the Japanese army. Freedom at last! In 1946 the people of the Philippines attained their independence, 148 years later than the freedom which was written down by Julian Felipe in the “Lupang Hinirang”.

For most westerners coming to the Philippines and seeing the value that most Filipinos have on “celebrities”, it will appear very strange. Huge pockets of the population live on starvation rations and yet will watch the TV Soaps and seem to know everything about the actors or actresses and will talk about their wealth and shopping trips to Hong Kong by private planes.

The distribution of wealth in the Philippines is still a scandal. There is no divorce in the Philippines, but if you are really rich you can get annulments with huge pay-outs. High profile cases include the presidents sister Kris Aquino who  has a very public battle with her husband.

Dollars and No Divorce

If you have a few thousand dollars you can get an annulment after a few years, but for most the simple truth is that there is not a easy way to get split from an unfaithful or loveless relationship. Therefore it is very easy to see a blind acceptance of men having other women and other families, if only divorce in the Philippines was allowed!

Marrying a foreigners is often the only way out of poverty for most Filipinos, but if they (Filipina) is already married this will put a huge financial and time burden on the foreigner to get the marriage annulled. But for certain parts of the population there is a legal divorce system.

Divorce in the Philippines

As a general rule, a divorce obtained abroad between two Filipino citizens is not valid or recognized in the Philippines. This is due to Article 15 of the Civil Code of the Philippines, which states that “laws relating to family rights and duties, or to the status, condition and legal capacity of persons are binding upon citizens of the Philippines, even though living abroad”. Moreover, Paragraph 3 of Article 17 of the same Code states that “prohibitive laws concerning persons, their acts or property, and those which have for their object public order, public policy and good customs shall not be rendered ineffective by laws or judgments promulgated, or by determinations or conventions agreed upon in a foreign country”.

The only exception is found in Article 26 of the Family Code of the Philippines, which states that “where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall have capacity to remarry under Philippine law.”
